These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," "your") and East Oak Capital LLC, doing business as WonTheJob ("Company," "we," "us," "our"), governing your access to and use of https://wonthejob.com and all related services ("Services").

WonTheJob is an AI-powered proposal platform that allows contractors to generate job proposals and automate homeowner follow-up communications. Our Services are intended for business use by licensed contractors and construction professionals.
No Professional Advice. All content generated by our Services, including AI-generated proposals, is provided for informational and convenience purposes only. It does not constitute legal, financial, professional, or contractual advice. You are solely responsible for reviewing, editing, and verifying all AI-generated content before use. We expressly disclaim all liability for errors, omissions, or inaccuracies in AI-generated content.
Service Availability. We do not guarantee that our Services will be available at all times, uninterrupted, or error-free. We reserve the right to modify, suspend, or discontinue any part of our Services at any time without notice or liability.
You must be at least 18 years of age and capable of entering into a binding legal agreement to use our Services. By using our Services, you represent and warrant that you meet these requirements.
You agree to provide accurate, complete, and current information when registering. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use at legal@wonthejob.com.
Account Termination. We reserve the right to suspend or terminate your account immediately, with or without notice, for any reason, including but not limited to violation of these Terms, suspected fraud, abuse of our platform, or failure to pay. Termination does not entitle you to a refund of any prepaid fees except at our sole discretion.
We offer monthly and annual subscription plans. By selecting a plan, you authorize us to charge your payment method on a recurring basis until you cancel. Subscriptions renew automatically unless cancelled before the renewal date.
We accept Visa, Mastercard, American Express, and Discover. All charges are in US dollars and processed securely by Stripe. We do not store your payment card information.
Free Plan. We offer a permanent free plan limited to 3 proposals per month with no credit card required. Free plan users may upgrade to a paid plan at any time to access additional features and higher proposal limits.
Refunds. Refunds are evaluated on a case-by-case basis. Contact legal@wonthejob.com to request a refund. We are not obligated to provide refunds for partial billing periods.
Cancellation. You may cancel your subscription at any time by contacting customer service. Access continues until the end of your current billing period. Cancellation does not automatically generate a refund.
Price Changes. We reserve the right to change subscription pricing at any time. We will provide at least 30 days notice before any price increase takes effect on your account.
WonTheJob sends up to 3 automated SMS messages per proposal over a 5-day period (Day 1, Day 3, Day 5) from your registered business name. Standard message and data rates may apply. Homeowners may opt out at any time by replying STOP. We honor all opt-out requests within a commercially reasonable time.
No Sharing of SMS Data. No mobile phone numbers or SMS opt-in data will be shared with third parties or affiliates for marketing or promotional purposes.
TCPA Indemnification. You agree to fully indemnify, defend, and hold harmless East Oak Capital LLC, its officers, directors, employees, and agents from and against any and all claims, damages, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your failure to obtain proper homeowner consent before entering phone numbers into our platform; (b) any violation of the Telephone Consumer Protection Act (TCPA) or any applicable state telemarketing law resulting from your use of our SMS features; or (c) any claim by a homeowner related to text messages sent using your account.
You are an independent business using our platform as a tool. You are not an employee, agent, partner, joint venturer, or representative of East Oak Capital LLC or WonTheJob. Nothing in these Terms creates any agency, partnership, or employment relationship between you and us.
All proposals you generate using our Services are your proposals, sent on your behalf, under your business name. East Oak Capital LLC has no responsibility for the content of proposals you send, the accuracy of information you enter, or the outcome of any contractor-homeowner relationship.
Our Services rely on third-party providers including OpenAI (AI processing), Stripe (payments), Twilio (SMS), Resend (email), Supabase (database), and Vercel (hosting). We are not responsible for the availability, performance, accuracy, security, or actions of any third-party service.
If a third-party service experiences an outage, data breach, pricing change, or discontinuation, we will make reasonable efforts to restore service but shall have no liability to you for any resulting interruption, loss of data, or service degradation.
Financing. Financing options displayed through WonTheJob are provided by third-party lenders including Wisetack Inc. WonTheJob is not a lender and does not offer, arrange, or guarantee financing. All financing is subject to lender approval and the lender's own terms and conditions. WonTheJob makes no representations regarding approval rates, interest rates, or terms.
You agree not to:
All content, features, functionality, code, branding, and technology of our Services are owned exclusively by East Oak Capital LLC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use our Services solely for your internal business purposes.
You retain ownership of any specific business information you input into our platform. However, by using our Services you grant us a non-exclusive license to process that data to provide the Services.
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR USE OF OUR SERVICES IS ENTIRELY AT YOUR OWN RISK.
Contractor Credentials. Contractor license numbers, insurance status, and credentials displayed on WonTheJob are self-reported by contractors. WonTheJob does not independently verify contractor licenses, insurance coverage, bonding status, or any other professional credentials. Homeowners should independently verify contractor credentials before entering into any agreement.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EAST OAK CAPITAL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO US IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Time Limitation. Any claim must be commenced within one (1) year after the cause of action accrues. After that period, such claim is permanently barred.
WonTheJob uses artificial intelligence to generate proposal content. All AI-generated proposals are drafts only. The contractor is solely responsible for reviewing, verifying, and approving all proposal content — including equipment specifications, materials, pricing, warranty terms, and scope of work — before sending to any homeowner. WonTheJob makes no warranty that AI-generated content is accurate, complete, or suitable for any specific job. Equipment brands, models, and specifications suggested by the AI are representative examples only and do not constitute a binding commitment to use specific products.
By using WonTheJob to generate and send proposals, the contractor confirms they have reviewed the proposal content and accept full responsibility for its accuracy. WonTheJob is not liable for any disputes, damages, or claims arising from inaccurate, incomplete, or misleading proposal content sent to homeowners. The contractor is responsible for ensuring all proposals comply with applicable licensing, bonding, insurance, and consumer protection laws in their jurisdiction.
Insurance Claim Proposals. WonTheJob's insurance claim proposal mode is a document generation tool only. Contractors using this feature are solely responsible for compliance with all applicable state and federal laws governing insurance claims, including but not limited to prohibitions on assignment of benefits, deductible waivers, and direct billing arrangements. WonTheJob assumes no liability for contractor compliance with insurance regulations.
Informal Resolution. Before initiating any formal proceeding, contact us at legal@wonthejob.com with a written description of the dispute. We will attempt resolution within 30 days.
Binding Arbitration. Unresolved disputes shall be settled by binding individual arbitration in the State of Kentucky. The arbitrator's decision shall be final and binding. We will pay arbitration fees if deemed excessive.
Governing Law & Venue. These Terms are governed by the laws of the State of Kentucky. Any court proceedings shall take place exclusively in the state or federal courts of Kentucky.
You agree to defend, indemnify, and hold harmless East Oak Capital LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including attorneys' fees) arising from: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any law or regulation; (d) TCPA violations resulting from your use of our SMS features; or (e) any content you submit through our Services.
We shall not be liable for any delay or failure to perform our obligations if caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, war, internet outages, third-party service provider failures (including OpenAI, Twilio, Stripe, Vercel, or Supabase), government actions, power failures, or cyberattacks.
We may modify these Terms at any time. We will notify you by email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
Entire Agreement. These Terms and our Privacy Policy at wonthejob.com/privacy constitute the entire agreement between you and East Oak Capital LLC and supersede all prior agreements.
Severability. If any provision is found invalid or unenforceable, it shall be modified to the minimum extent necessary, and remaining provisions continue in full force.
Waiver. Our failure to enforce any provision shall not constitute a waiver of that right.
Assignment. You may not assign your rights under these Terms without our written consent. We may assign ours freely.
No Third-Party Beneficiaries. These Terms are solely for the benefit of you and East Oak Capital LLC.
